These Terms and Conditions ("Terms") govern your use of the Waistra cloud storage app (the "App") provided by Waistra Inc. ("We," "Our," or "Us"). By using the App, you agree to comply with these Terms. If you do not agree with any part of these Terms, please refrain from using the App.
1. Use of the App:
1.1 Eligibility: By using the App, you represent that you are at least 13 years old or have the necessary legal capacity to enter into these Terms.
1.2 App Access: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
1.3 Account Registration: To access certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and ensuring the security of your account.
2. User Obligations:
2.1 Compliance: You agree to use the App in compliance with all applicable laws, regulations, and these Terms. You are solely responsible for any content you upload, store, or share through the App.
2.2 Prohibited Activities: You must not engage in any of the following activities while using the App:
(a) Violating any laws or infringing upon any intellectual property rights;
(b) Uploading or sharing any content that is unlawful, harmful, obscene, defamatory, or infringing upon the rights of others;
(c) Engaging in any unauthorized access, interference, or disruption of the App's operation;
(d) Circumventing or attempting to circumvent any security measures or authentication systems;
(e) Using the App to distribute or transmit any viruses, malware, or other harmful computer code;
(f) Engaging in any activity that could impair or harm the App's functionality or interfere with other users' experience.
3. Privacy:
3.1 Privacy Policy: Your use of the App is subject to our Privacy Policy. Please refer to the Privacy Policy for information on how we collect, use, store, and protect your personal information.
4. Modification of the App:
4.1 Feature Changes: We reserve the right to add, modify, or remove any features, functions, or services within the App with or without prior notice.
4.2 Associated Data: In the event of adding, modifying, or removing features, functions, or services, we may also add, modify, or remove associated data that is no longer necessary for the App's operation or improved functionality. Such actions may occur with or without any prior notice.
5. Data Ownership and Backup:
5.1 Data Ownership: You retain full ownership and control of your files and personal information uploaded to the App.
5.2 Data Backup: We highly recommend that you maintain regular backups of your files. We will not be responsible for any loss of data, whether due to accidental deletion, system failure, or any other reason. You acknowledge and agree that you are solely responsible for keeping backups of your files and other data.
6. Intellectual Property:
6.1 Ownership: The App and all associated intellectual property rights are owned by Waistra Inc. All rights not expressly granted to you under these Terms are reserved by us.
6.2 Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes as permitted by these Terms.
7. Limitation of Liability:
7.1 Disclaimer: The App is provided on an "as-is" and "as available" basis, without any warranties or representations, express or implied. We do not guarantee the accuracy, completeness, or reliability of the App or any content accessed through the App.
7.2 Limitation of Liability: To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the App. This includes, but is not limited to, any data loss or damage to your files.
8. Modification of Terms:
8.1 Modifications: We reserve the right to modify, update, or replace these Terms at any time. We may do so with or without prior notice. Your continued use of the App after any changes to the Terms signifies your acceptance of those changes.
9. Termination:
9.1 Termination by You: You may terminate your use of the App at any time by deleting your account and ceasing all access and use of the App.
9.2 Termination by Us: We reserve the right to terminate or suspend your access to the App, in whole or in part, at our discretion and without prior notice.
10. Governing Law:
10.1 Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Jaipur, India. Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of [Jaipur, India]
